Boca Raton, Florida CVS Pharmacy Sued for the Second Time in One Week
On August 28, 2009, attorney Howard Weitzner of the law firm of Greenberg & Stone, P.A. sued for the second time in one week the same CVS pharmacy in Boca Raton, Florida, for improperly filling and dispensing medication to its customers.
BOCA RATON, FL, September 01, 2009 /Pharmaceutical PR News/ -- On August 28, 2009, attorney Howard Weitzner of the law firm of Greenberg & Stone, P.A. sued for the second time in one week the same CVS pharmacy in Boca Raton, Florida, for improperly filling and dispensing medication to its customers. The pharmacy, a CVS store located at 7016 Bera Casa Way, Boca Raton, Florida, is alleged in the latest suit to have given an elderly woman, who was recovering from recent surgery and taking a number of medications, a powerful and dangerous anticonvulsant medication that had not been prescribed to her. She suffered severe side effects and symptoms and her recuperation was at least temporarily halted. In the earlier suit, the CVS pharmacy is alleged to have negligently given a woman blood pressure lowering medication, though she was prescribed by her physician medication to raise her abnormally low blood pressure.
The pharmacy errors occurred within less than four months of one another, which attorney Howard Weitzner, who filed the lawsuits, says is cause for concern.
"Any time you see such clear errors made within such a short amount of time, you have to worry," Weitzner said. "It sends up a red flag and you have to wonder if this is part of a bigger problem, a practice or some sort of flaw in the system in place at the pharmacy."
The plaintiffs in each of the lawsuits required medical attention following their being given the wrong medication. Specific details regarding their medical attention were asked to be kept confidential. CVS has not yet responded to the lawsuits.
"Our top concern at this stage is the health and well-being of our clients and we will do whatever we can to make sure they make a full recovery and that their rights are protected," says Weitzner. "But when you see two serious prescription drug errors occur at the same pharmacy, it is important that the consumer be made aware of the potential problem there. We encourage everyone to check their prescriptions carefully and ask their pharmacists questions, regardless of where you have them filled, but especially if the pharmacy has a history of making mistakes.
Research has shown errors are made in as many as 10 percent of all prescriptions filled in the United States. This can include the wrong medication or the wrong dosage.
